Peters takes plea

ANDERSON - Tyus Jamond Peters, age 22, of Humble plead guilty to the 2016 murder of David Avery Brown, age 19, of Conroe.

Peters initial trial in 2017 was under former Grimes County district attorney Tuck McClain, who is now the Grimes County Court at Law Judge and handled by Jo Ann Linzer. The trial resulted in a hung jury.

A jury was selected Tuesday, Aug. 6. Peters arrived for court the following day and through his attorney Laurie Sellers, indicated he wanted to enter a guilty plea and accept a 15-year prison sentence. The same plea was previously rejected.

Grimes County district attorney Andria Bender visited with Brown’s family and they indicated they wanted prosecutors to accept the plea to guarantee a conviction and spare the family from enduring another trial.

According to Bender the family didn’t want to risk the possibility of another hung jury and the decision to accept the plea brought a sense of closure eliminating years of possible appeals after a trial.

Ms. Black and her children each had the opportunity to address Peters in court to express their feelings regarding him taking the life of David Avery Brown.

Peters and three other men went to the apartment where Brown lived in Con-roe Tuesday, April 12, 2016 to collect money Peters said he was owed.

When Brown stated he didn’t have the money, a witness stated Peters threatened Brown with a gun and suggested they commit a burglary to get the money. Brown left with Peters and the other individuals.

While driving around and looking for a potential burglary target, Brown told Peters a friend recently gave him speakers and they could drive to the Grimes County residence on CR 306 in Stoneham to retrieve them and Brown would give the speakers to Peters to satisfy some of the debt owed.

After the speakers were retrieved and loaded into the vehicle Peters pointed the gun at Brown and a witness said Brown pleaded for his life but Peters shot him multiple times. Peters then handed the gun to one of the other men in the vehicle and told him to finish Brown off. The male acted as if the gun wasn’t working and then fired several shots into the ground.

A woman that lived nearby reported hearing gunshots at approximately 11:30 p.m. A short time later she said a man was banging on her door, but she was alone and scared so she didn’t answer the door. The following morning, she found Brown dead on her front porch.

Peters was arrested at 12:07 a.m. Friday, April 15, 2016.

Peters was booked into the Grimes County Jail after entering a guilty plea and will be transported to Texas Department of Criminal Justice to carry out his sentence.
